TERMS & CONDITIONS

These Terms & Conditions govern all orders placed with Velvet Bloom Pastries. By submitting payment, the client agrees to the following:
1. Booking & Retainer
A signed agreement and a non-refundable retainer of 50% are required to secure your event date.
Dates are not reserved until both the signed agreement and retainer have been received.
The remaining balance is due 14 days prior to the event date. Failure to submit final payment by the due date may result in cancellation of services without refund of retainer.
2. Minimum Investment
Full dessert table installations require a minimum investment of $800. This minimum is firm and non-negotiable — no exceptions will be made for full dessert table setups regardless of item count or scope.
Smaller custom orders (individual cakes, custom desserts, or partial arrangements not constituting a full dessert table) may be accepted based on availability and design scope at our discretion.
3. Cancellations & Refunds
All retainers are non-refundable, as your event date is reserved exclusively for you.
If cancellation occurs:
More than 30 days before the event: any payments made beyond the retainer may be credited toward a future event within 6 months (subject to availability).
Within 30 days of the event: all payments are non-refundable due to scheduling, sourcing, and preparation commitments.
4. Cancellation by Velvet Bloom Pastries
In the rare event that Velvet Bloom Pastries must cancel your order for reasons within our control — including but not limited to personal illness, injury, family emergency, or any other circumstance that prevents us from completing your order — the following policy applies:
You will receive a full refund of all payments made, excluding the non-refundable 25% deposit.
We will notify you as soon as possible and make every reasonable effort to provide advance notice.
This policy applies to studio-initiated cancellations only and is separate from the Force Majeure clause outlined in Section 12.
5. Design & Artistic Discretion
All desserts are custom designed based on the agreed theme, flavor selections, and aesthetic direction.
Inspiration images are welcome; however, final designs remain at the discretion of the pastry studio to ensure structural integrity, artistic quality, and brand consistency.
Because each item is handcrafted, slight variations in color, brushwork, and detail are expected and part of the artisanal process.
6. Allergen & Cottage Kitchen Disclosure
Products are prepared in a home kitchen in Denver, Colorado that processes common allergens including:
Dairy
Eggs
Wheat
Soy
Peanuts
Tree nuts
While care is taken in preparation, we cannot guarantee the absence of cross-contact. It is the client’s responsibility to inform guests of potential allergens.
7. Delivery & Acceptance
Delivery fees are determined by location and setup requirements.
Once delivery is completed, responsibility for the desserts transfers to the client upon any of the following forms of acceptance: verbal confirmation at the time of delivery, a written acknowledgment, or a text message confirming receipt of the order.
We are not liable for damage caused after delivery due to improper handling, environmental conditions, or storage.
8. Outdoor Events & Weather Clause
Colorado weather can be unpredictable. For outdoor events, the client is responsible for providing:
A fully shaded dessert area
Protection from direct sunlight
A stable, level surface
Coverage from wind and precipitation
Temperature control whenever possible
Chocolate, mousse-based, and specialty desserts are temperature-sensitive and may soften, melt, or structurally compromise in heat, humidity, or direct sun exposure. If adequate shade or protection is not available upon arrival, we reserve the right to modify the display, delay setup, or withhold certain items to preserve product quality and food safety. We are not liable for damage, melting, or structural changes caused by outdoor weather conditions.
9. Rentals & Display Items
If display stands, risers, or decorative elements are provided:
The client assumes responsibility for any loss, theft, or damage during the event.
Replacement fees will be invoiced as needed.
10. Storage & Care
Perishable items must be refrigerated until service unless otherwise instructed.
Desserts should be served in a climate-controlled environment whenever possible.
Failure to follow care instructions releases the studio from liability.
11. Photography & Marketing
Velvet Bloom Pastries reserves the right to photograph all completed work for use in our portfolio, website, and social media channels.
We love when our clients share their experience! You are welcome and encouraged to tag us in any photos or videos featuring our desserts on social media. Our handle and hashtags will be provided with your order confirmation.
By sharing content featuring our work and tagging Velvet Bloom Pastries, you grant us permission to repost, reshare, or feature your content on our social media platforms or website. Credit will always be given where possible.
If your event requires privacy or non-disclosure of our work, written notice must be provided prior to the event date, and we will honor that request fully.
12. Force Majeure
In the event of circumstances beyond our control (severe weather, natural disasters, illness, venue closure, government restrictions, etc.), we reserve the right to reschedule services. Payments may be transferred to a future available date.
13. Limitation of Liability
Liability is limited to the total amount paid for services rendered.
